Any of you have legal knowledge of Maryland law regarding the possibility that a public right of way, or easement, has been established at Sandy Hook by now? I have personally been crossing there for 30 years. But my legal knowledge is limited to the traffic citations of my youth. I think its time for the paddling community to approach CSX and tell them we are willing to work with them to create a crossing at Sandy Hook. Weather that be an improved surface bed flush with the tracks with possible signals, or a raised bridge to walk across even when trains are present. We should be willing to help foot the bill. I think we can raise a significant portion of the cost of the project.
And we should be prepared to use that money to file suit against them to force them to build it on their own if they fail to cooperate promptly.
I'm sure most of us would prefer the 1st option, but this has gone on long enough.
So how about it? Any legal expertise here?
